Most people will be surprised to learn just how many people are arrested every year. The vast majority of those arrested are ordinary people just like themselves. But people are not perfect. They take a chance and drive when they had that one drink too many. They allow their emotions to rule their actions. They make risky decisions. All of this may lead to criminal charges and an arrest. When facing criminal charges, it is important to realize that the matter is very serious. A conviction will lead to a life long criminal record. This can ruin careers, families and even the finances of the person that was arrested. When arrested, the first and most important priority is to hire the services of a reputable criminal defence lawyer. Defending oneself is not really an option.

It is not feasible to keep every arrested person incarcerated, nor would it be fair. The majority of accused are therefore allowed to go free until their cases can be heard. However, the court must first be satisfied that the accused will adhere to the conditions of release. He may not interfere with the case, he must not pose a danger to himself or others and he must be likely to attend his trial.

Before the accused is actually released he has to post a bond to serve as security that he will attend his trial. Bondsmen specializes in providing quick loans to those that need to post a bond.

Bondsmen know that their clients are not really in a position to negotiate. They charge service fees as high as fifteen percent of the overall loan amount. This can easily become a very high fee if the loan amount is high. In addition, the client will have to sign over fixed assets such as their homes to secure the loan. The service fee is not refundable and the payment thereof is stipulated in a contract.

The terms and conditions of the contracts offered by bondsmen are very strict and they often contain severe penalty clauses. Clients often never even read these terms and conditions when they sign the contract. This is because they are still traumatised from the arrest and simply want to be released as quickly as possible. It is for this reason that all negotiations should be left to the lawyer.

Breaking the conditions for release can have very serious ramifications. It should not even be considered. Not only will the accused be arrested, but he will also face additional criminal charges. The amount initially posted as a bond will be forfeited and he will have to apply for release again and once more negotiate a loan from the bondsmen. This can turn out to be financially crippling.

There are those that insist that everyone arrested should be kept in jail until their cases are finalized. This would be unfair, however, because it may take many weeks or months for a case to be heard. After all, it is the constitutional right of every accused to be treated as not guilty until the court actually finds him guilty.
